КИБЕРБУЛЛИНГ (КИБЕРНАСИЛИЕ) В СОЦИАЛЬНЫХ СЕТЯХ И ЮРИДИЧЕСКАЯ ОТВЕТСТВЕННОСТЬ

Настоящее исследование посвящено актуальной социально-правовой проблеме, обусловленной стремительным развитием информационных технологий и социальных сетей, – кибербуллингу (кибернасилию) в социальных сетях, его правовому регулированию и механизмам юридической ответственности. В исследовании использованы методы сравнительно-правового анализа, анализа национального законодательства и международно-правовых актов, а также изучения отечественного и зарубежного (европейского) опыта правового регулирования. В целях определения уровня осведомлённости пользователей социальных сетей о понятии кибербуллинга и мерах ответственности за его совершение был проведён социологический опрос. Проведённый анализ свидетельствует, что в действующем законодательстве Республики Узбекистан правонарушения, совершаемые в онлайн-среде, преимущественно квалифицируются в рамках традиционных норм об ответственности за клевету, оскорбление и нарушение неприкосновенности частной жизни. В заключение статьи сформулированы научно-практические предложения и рекомендации по включению в законодательство специальных норм, совершенствованию системы правовой защиты потерпевших, а также повышению правосознания и правовой культуры населения в целях усиления эффективности противодействия кибернасилию.
