ВОПРОСЫ СОВЕРШЕНСТВОВАНИЯ НАЦИОНАЛЬНО-ПРАВОВЫХ ОСНОВ ОБЕСПЕЧЕНИЯ ПРАВА НА ОБРАЩЕНИЕ В МЕЖДУНАРОДНЫЕ ОРГАНЫ

В статье проанализированы национально-правовые основы обеспечения права на обращение в международные органы. Цель исследования заключается в выявлении существующих в действующем законодательстве пробелов процессуального, институционального и компенсационного характера, а также в обосновании способов их устранения. Рассмотрены современное состояние законодательства Узбекистана, механизмы взаимодействия с договорными комитетами ООН и проблемы реализации их решений на национальном уровне. На основе сравнительно-правового, формально-юридического и системного методов проведён сравнительный анализ опыта Колумбии, Испании и Перу. По результатам исследования разработаны предложения по определению процессуальных последствий соображений международных органов, совершенствованию механизмов выплаты компенсации и расширению юридической помощи. Сформулированные в статье предложения и рекомендации могут способствовать приведению законодательства Узбекистана в соответствие с международными стандартами и его интеграции в международно-правовую систему, а также определению новых направлений реформ в области прав человека.
