Аннотация

В статье с конституционно-правовой точки зрения анализируется проблема ограничения незаконного вмешательства государственных органов в предпринимательскую деятельность. Раскрывается взаимосвязь между экономической свободой, неприкосновенностью частной собственности, административными процедурами и прозрачностью государственного контроля. Цель исследования заключается в раскрытии гарантий экономической свободы, закреплённых в Конституции Республики Узбекистан в новой редакции, во взаимосвязи с механизмами ограничения необоснованного вмешательства в предпринимательскую деятельность. По результатам исследования обоснована необходимость обеспечения ограничения незаконного вмешательства гарантиями законности, соразмерности, цифровой прозрачности, эффективного обжалования и возмещения вреда, а также сформулированы предложения по совершенствованию законодательства.
