ПЕРСПЕКТИВЫ ИМПЛЕМЕНТАЦИИ ПОДХОДА DIGITAL SERVICES ACT В НАЦИОНАЛЬНУЮ СИСТЕМУ РЕГУЛИРОВАНИЯ

В статье анализируются перспективы внедрения подхода Акта о цифровых услугах (Digital Services Act, DSA) Европейского союза в систему правового регулирования цифровых платформ Республики Узбекистан. На основе сравнительно-правового анализа выявлены ключевые принципы Digital Services Act – приоритет прав пользователей, ответственность платформ, прозрачность алгоритмов и модерационных практик – и показано их соотношение с национальным законодательством. Рассматриваются недавние законодательные инициативы, включая проект закона «О защите прав пользователей онлайн-платформ и веб-сайтов». Отмечаются преимущества адаптации DSA-подхода (защита пользователей, повышение ответственности провайдеров, гармонизация с международными нормами), а также потенциальные вызовы его внедрения. Сделан вывод, что DSA может стать основой модернизации цифрового регулирования Узбекистана при условии адаптации его положений к национальным особенностям и обеспечения эффективного взаимодействия государства, бизнеса и общества.
