THE ROLE AND SIGNIFICANCE OF THE EXPERT CONCLUSION AS A MEANS OF PROOF

This article provides a comprehensive study of the role and significance of expert testimony as a tool of proof in criminal proceedings. It analyzes the legal nature of expert testimony and distinguishes it from witness statements, specialist opinions, and physical evidence. The admissibility, relevance, reliability, and sufficiency of expert testimony are highlighted as the primary criteria for evaluating it as evidence. Furthermore, the article substantiates that expert testimony does not possess predetermined binding force for courts and investigative authorities and must be objectively evaluated in conjunction with other evidence. The study examines issues related to ensuring the scientific and methodological foundation of expert testimony, defining the legal boundaries of an expert’s competence, prohibiting the submission of questions of a legal nature to experts, and validating forensic methodologies. Finally, the author presents scientific and practical proposals aimed at improving the criminal procedural legislation of the Republic of Uzbekistan.
