THE CONCEPT, ESSENCE, AND CLASSIFICATION OF TYPES OF ILLEGAL ACTS RELATED TO CRYPTO-ASSETS

Abstract

This article theoretically and practically examines the legal nature, essence, and classification criteria of illegal acts committed in the field of crypto-assets and mining. The traditional (instrumental), technocratic and economic-institutional approaches in the doctrine of criminal law are critically analyzed, and the author’s proposals are put forward. Modern foreign concepts and standards of international organizations (FATF, TRM Labs) were also studied. As a result of the study, new author’s definitions of crypto-offenses at the national and transnational levels have been formed. Deeds are classified according to their legal consequences and object, and three new digital classes of crypto-crimes are theoretically substantiated based on advanced foreign experience.
