МЕТОДОЛОГИЧЕСКИЕ ОСНОВЫ МЕХАНИЗМА ОБЕСПЕЧЕНИЯ ПРАВ И СВОБОД ЧЕЛОВЕКА

В статье комплексно проанализированы методологические основы механизма обеспечения прав и свобод человека, раскрыты содержание и различия таких правовых категорий, как «обеспечение», «осуществление», «реализация», «гарантирование», «охрана» и «защита». Рассмотрены нормативный, институциональный, организационный и процессуальный аспекты механизма обеспечения прав человека, систематизированы его субъекты, объект и основные принципы. В исследовании обосновано понимание «обеспечения» как более широкой по своему содержанию категории, охватывающей реальное осуществление прав, их охрану и восстановление нарушенных прав и представляющей собой целостный механизм. Кроме того, определены основные принципы, обусловливающие эффективность данного механизма, и обоснована их функциональная взаимосвязь.
