TRENDS AND PROSPECTS FOR THE DEVELOPMENT OF ADMINISTRATIVE PROCEDURES IN THE COUNTRIES OF THE EUROPEAN UNION

The article examines trends in the development of the institution of administrative procedures in European states and in European Union law, taking into account national models and supranational standards of good administration. Administrative procedure is considered a legal guarantee of legality, transparency, participation by interested parties, and the protection of their rights. On the basis of comparative legal analysis, the article identifies the distinctive features of the German model, which is based on legislative codification, and the British model, which has developed primarily through the common law, the activities of tribunals, and ombudsmen. Particular attention is paid to Article 41 of the Charter of Fundamental Rights of the European Union, Article 298 of the Treaty on the Functioning of the European Union (TFEU), and the ReNEUAL Model Rules. The article substantiates the emergence of a common European core of procedural standards while preserving national diversity. It also identifies a trend towards strengthening requirements concerning the statement of reasons for administrative decisions, the right to be heard, access to case materials, compliance with reasonable time limits, and the effectiveness of review and oversight mechanisms.
