JUDICIAL CONTROL OVER THE IMPLEMENTATION OF ADMINISTRATIVE DISCRETION (DISCRETIONARY AUTHORITY) BY THE ADMINISTRATIVE AUTHORITIES OF THE REPUBLIC OF UZBEKISTAN

The article examines the theoretical and practical issues of judicial review over the exercise of administrative discretion (discretionary powers) by administrative authorities of the Republic of Uzbekistan. It analyses the concept of administrative discretion as established in the Law of the Republic of Uzbekistan “On Administrative Procedures,” clarifies its administrative-law nature, and determines its place within the mechanism for adopting administrative acts. Particular attention is paid to defining the subject matter and limits of judicial review, as well as the criteria for assessing the legality, proportionality, reasonableness, and purpose-oriented nature of an administrative act adopted in the exercise of administrative discretion. Using the comparative legal method, the article examines the German doctrine of administrative discretion and the concept of the legal stability of an administrative act. Based on the findings of the study, proposals are formulated for improving judicial review over the exercise of administrative discretion in the Republic of Uzbekistan.
