PECULIARITIES OF CONSIDERING PUBLIC LAW DISPUTES IN THE FIELD OF EMPLOYMENT IN ADMINISTRATIVE COURTS

Abstract

This article comprehensively analyzes the specific characteristics of resolving public law disputes in the field of employment by administrative courts in the Republic of Uzbekistan. Within the framework of the research, the provisions of the Law “On Administrative Procedures,” the Code of Administrative Court Proceedings, and the Law “On Population Employment” were examined in interconnection. Based on judicial practice, the article highlights issues related to the burden of proof allocation, the obligation to substantiate administrative acts, and the inactivity of state bodies. Additionally, the experience of German and French administrative law was analyzed through a comparative legal approach, identifying their advanced practices. As a result of the study, systemic shortcomings in the application of current legislation were revealed, and scientifically grounded proposals aimed at effectively protecting the rights and legitimate interests of citizens were developed. Furthermore, the necessity of ensuring procedural justice principles in court activities, enhancing the accountability of state bodies, and legally regulating new types of disputes arising under digital services was substantiated.
