THEORETICAL ANALYSIS OF EXTRADITION IN CRIMINAL CASES

The article comprehensively examines the theoretical foundations and development trends of extradition in criminal cases. The institution of extradition is a complex and dynamically evolving field of international criminal law that requires a balance between states’ domestic legislation and their international obligations. The relevance of the topic stems from the fact that current discrepancies between national legislative procedures, jurisdictional issues, and human rights protection standards give rise to various practical challenges, thereby underscoring the need for a thorough scientific analysis of the theoretical and legal – particularly doctrinal –foundations of extradition. The research methodology relies on a combination of general scientific and specialized legal methods, including etymological, doctrinal, comparative-legal, and empirical analysis. The article substantiates the necessity of improving the theoretical and conceptual frameworks of extradition in criminal matters, proposing an original author’s definition of extradition alongside recommendations for refining relevant legislation.
