SPECIFIC FEATURES OF AMENDING PUBLIC PROCUREMENT CONTRACTS

Abstract

This article analyzes the introduction of amendments to public procurement contracts based on current legislation. Although civil law allows for unlimited changes to the contract at the discretion of the parties, the specific legal nature of the public procurement contract permits only certain modifications. The scientific work highlights the insufficient regulation of the institution of amending a public procurement contract in legislation, restrictions on concluding an additional agreement, and problems related to the application of the law. In particular, barriers to payment for additional work performed will be analyzed. A comparative analysis is also conducted based on the experience of Germany, Austria, and Kazakhstan, revealing the advantages of a “significant change” and a clear list of changes. At the end of the study, proposals were developed to improve contractual relations.
